To facilitate the implementation of the global indicator framework, all indicators are classified by the IAEG-SDGs (Inter-Agency and Expert Group on Sustainable Development Goals Indicators) into three tiers on the basis of their level of methodological development and the availability of data at the global level, as follows:
Tier I: Indicator is conceptually clear, has an internationally established methodology and standards are available, and data are regularly produced by countries for at least 50 per cent of countries and of the population in every region where the indicator is relevant.
Tier II: Indicator is conceptually clear, has an internationally established methodology and standards are available, but data are not regularly produced by countries.
Tier III: No internationally established methodology or standards are yet available for the indicator, but methodology/standards are being (or will be) developed or tested.

Rationale: The indicator signifies overall respect for the principle that persons awaiting trial shall not be detained in custody unnecessarily. This, in turn, is premised on aspects of the right to be presumed innocent until proven guilty. From a development perspective, extensive use of pre-sentence detention when not necessary for reasons such as the prevention of absconding, the protection of victims or witnesses, or the prevention of the commission of further offences, can divert criminal justice system resources, and exert financial and unemployment burdens on the accused and his or her family. Measuring the relative extent to which pre-sentence detention is used can provide the evidence to assist countries in lowering such burdens and ensuring its proportionate use.
Limitations: The target relates to the multidimensional concepts of rule of law and access to justice and at least two indicators are required to cover the main elements of access to justice and efficiency of the justice system. The proposed indicator 16.3.2 covers the efficiency of the justice system.
